You are responsible for how you use the Services and for the files and content you submit. Without limiting the foregoing, you agree that:

• You will use the Services only for lawful purposes and in accordance with these Terms.
• You are solely responsible for the files, data, and other content you upload, convert, download, or otherwise process through the Services.
• You have all rights and permissions needed to submit content for processing and to use any resulting outputs.
• You will not attempt to interfere with the normal operation, security, or integrity of the Services.
• You will keep any account credentials (if accounts are offered) confidential and promptly notify us of unauthorized access.

The Services—including the website design, branding, text, graphics, logos, software, and other materials we provide—are owned by OneFileKit or its licensors and are protected by intellectual property laws.

Except for the limited right to use the Services as permitted under these Terms, no license or ownership interest in our intellectual property is transferred to you.

You retain ownership of content you upload. By submitting content to the Services, you grant us a limited, temporary license to process that content solely as needed to operate the requested tool features and to maintain, secure, and improve the Services in accordance with our policies.

You agree not to misuse the Services. Prohibited activities include, without limitation:

• Uploading, processing, or distributing content that is illegal, harmful, or that you do not have rights to use.
• Attempting to reverse engineer, scrape, overload, or disrupt the Services, or to bypass rate limits or security controls.
• Uploading malware, viruses, or other malicious code.
• Using the Services to infringe intellectual property, privacy, or other rights of third parties.
• Misrepresenting your identity or affiliation in connection with the Services.

We may investigate suspected violations and take appropriate action, including limiting or terminating access, where permitted by law.

We design file-processing workflows with privacy and security in mind. Files you submit are processed to fulfill your requested operation.

Processed files are intended to be retained only as needed to complete your request and then removed according to our operational policy. File conversions and other tool outputs may contain errors; you are responsible for verifying results before relying on them.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ONEFILEKIT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US (IF ANY) FOR THE SERVICES GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100) OR THE LOCAL-CURRENCY EQUIVALENT — SUBJECT TO FINALIZATION BY LEGAL COUNSEL FOR YOUR JURISDICTION AND BUSINESS MODEL.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including liability for death or personal injury caused by negligence, or for fraud, where such exclusions are prohibited).

To the extent permitted by law, you agree to indemnify and hold harmless OneFileKit and its officers, directors, employees, agents, and affiliates from and against claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Services; (b) content you submit; (c) your violation of these Terms; or (d) your violation of any law or third-party right.
